The State of Washington classifies DUI as a Gross Misdemeanor and has the possibility of 364/days in jail and a $5000 fine. It is unlikely that a judge would impose the maximum penalty on a first offense. However, Washington State does have mandatory jail time for all DUI convictions.
FIRST DUI CONVICTION (within 7 years)
Breath Test of 0.15 or BELOW or No test (you must not have refused the breath test)
- 1-364 days in jail (judge must impose 1 day jail)
- $1200 - $5000 in fines.
- 90 day drivers license suspension
- SR - 22 drivers license insurance for three years
- Ignition Interlock device required to drive for 1 year
- Alcohol Evaluation and Treatment
- Court supervised probation for a period of 2-5 years
- Travel to Canada prohibited
Breath Test of 0.15 or ABOVE or refusal to take a breath test
- Between 2-364 days in jail (judge must impose minimum of 2 days)
- Between $1200 - $5000 in fines.
- 1 year drivers license suspension or 2 years if refusal
- SR-22 Insurance for 3 years
- Ignition Interlock Device required to drive for 1 year
- Alcohol Evaluation and Treatment
- Court Supervised probation for a period of 2-5 years
- Travel to Canada prohibited
SECOND DUI CONVICTION (within 7 years)
- Between 30-364 days in jail (judge must impose minimum of 30 days)
- Between $1200 - $5000 in fines.
- 2 year drivers license suspension or 2 years
- SR-22 Insurance for 3 years
- Ignition Interlock Device required to drive for 1-5 years
- Alcohol Evaluation and Treatment
- Court Supervised probation for a period of 2-5 years
- Travel to Canada prohibited
