Bail and Release

Handling bail and release on in a homicide case requires experience and knowledge. Bail in these matters is generally set between $250,000 - $5,000,000 depending on the facts of the case.

Bail Hearing before Judge

It is critical to have an experienced attorney that can gather a large amount of information in a short amount of time in order to present bail arguments to the judge. Presenting arguments of self-defense, innocence or other mitigating factors early in the case can lower the bail amount and make release possible. 

 Many considerations go into the decision to post bail or alternatively not post bail. If the defendant is in custody and does not post bail then they will be accruing Credit for Time Served (CFTS).  If they post bail and are released then they will not.

Because the posting of bail in these cases may cost tens or hundreds of thousands of dollars it is a serious decision that you should make with a qualified criminal defense attorney. Releasing the defendant may make it easier to work with in preparation of the case.  However, exhausting your families financial resources to post bail may not be in your best interest.
